Terms & Conditions
1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of The Wonder Nepal website and marketplace platform, located at thewondernepal.com (the "Platform"), operated by The Wonder Nepal ("we", "us", or "our"). By accessing or using the Platform in any way — including browsing content, creating an account, listing a tour or guide profile, or making a booking — you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform. We recommend you read these Terms carefully before proceeding.
[REVIEW: legal team — confirm entity name, registration details, and registered address]2. Nature of the Platform
The Wonder Nepal is a marketplace platform. We connect independent travelers with local guide operators and tour companies registered in Nepal. We are not a travel agency, tour operator, or guide ourselves. We do not sell, operate, or manage any tours listed on the Platform.
All tour packages and guide profiles are created, managed, and fulfilled by third-party operators ("Guides"). The Wonder Nepal acts solely as an intermediary and is not party to any agreement between a traveler and a guide beyond facilitating the booking transaction.
All prices displayed on the Platform are inclusive of applicable taxes (GST-inclusive pricing) where stated. Prices are denominated in Nepali Rupees (NPR) unless otherwise specified.
3. User Accounts
3.1 Registration
To access certain features of the Platform — including making bookings or listing a guide profile — you must create an account. You agree to provide accurate, complete, and current information during registration and to keep your account information updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account where you have failed to take reasonable precautions.
3.3 Account Suspension
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or cause harm to other users or to the Platform.
4. Guide Listings
Guides who list profiles and tour packages on the Platform must comply with all applicable laws of Nepal, including holding valid government-issued guide licenses (for freelancers) or company registration and tourism licenses (for companies). Guides are solely responsible for the accuracy of their listings, the safety of their tours, and their compliance with Nepali tourism regulations.
The Wonder Nepal conducts a verification review of submitted documentation but does not independently verify every claim made in a guide's profile. Travelers are encouraged to request and verify documentation directly with guides before confirming a booking.
[REVIEW: legal team — specify verification liability limits and warranty disclaimers]5. Bookings and Payments
Bookings made through the Platform constitute an agreement between the traveler and the guide. Payment for bookings is processed or recorded through the Platform and is subject to the Refund Policy. All prices are in NPR and are GST-inclusive unless otherwise stated.
A booking is confirmed only upon receipt of full payment and written confirmation from The Wonder Nepal. Provisional bookings may be cancelled if payment is not received within the specified time window.
6. User Conduct
By using the Platform you agree not to:
- Upload, transmit, or distribute harmful, offensive, defamatory, or illegal content.
- Misrepresent your identity, affiliation, or qualifications.
- Interfere with the technical operation of the Platform.
- Circumvent the Platform to conduct bookings directly with guides you discovered through the Platform, in violation of our commission structure.
- Engage in price manipulation, fake reviews, or any conduct intended to deceive travelers or guides.
- Collect personal information about other users without their consent.
7. Content and Intellectual Property
All editorial content on the Platform — including articles, photography, and videos created by The Wonder Nepal — is protected by copyright and may not be reproduced, modified, or distributed without our prior written consent.
Guides retain ownership of their listing content (tour descriptions, images, itineraries) but grant The Wonder Nepal a non-exclusive, royalty-free, worldwide licence to display, adapt, and promote that content on the Platform and associated marketing channels.
[REVIEW: legal team — confirm licence scope and whether sublicensing rights are required]8. Limitation of Liability
To the fullest extent permitted by applicable law, The Wonder Nepal shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, a booked tour, or a guide's services. Our total liability in any dispute shall not exceed the total fees paid by you to The Wonder Nepal in connection with the transaction that gave rise to the dispute.
We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Changes to Terms
We may update these Terms from time to time. Changes take effect immediately upon posting. Continued use of the Platform after updated Terms are posted constitutes your acceptance of the changes. We will notify registered users of material changes via email where reasonably practicable.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
